1. Introduction & Acceptance

These Terms of Service ("Terms") govern your access to and use of the website themakhana.in (the "Site") and any purchase you make from The Makhana, a direct-to-consumer brand based in Delhi, India ("we", "us" or "our"). By browsing the Site, creating an order or otherwise using our services, you agree to be bound by these Terms. If you do not agree with any part of them, please do not use the Site or place an order.

Please read these Terms together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy, which form part of your agreement with us.

2. Eligibility

To place an order on the Site you must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872. If you are using the Site on behalf of a business or another person, you confirm that you are authorised to accept these Terms on their behalf.

3. Products & Pricing

  • All prices are listed in Indian Rupees (INR). The price shown for each product is the maximum retail price (MRP), inclusive of all applicable taxes including GST. Shipping charges, if any, are shown separately at checkout before you pay.
  • We try to describe and display our products as accurately as possible. However, product images are illustrative; actual packaging, colour and appearance may vary slightly, and pack weights are subject to standard permissible variations.
  • Prices, offers and product availability may change at any time without prior notice. The price that applies to your order is the price displayed at the time you place it.
  • In the rare event that a product is listed at an incorrect price due to a technical or human error, we reserve the right to cancel the order and refund the full amount already paid to your original payment method.

4. Food Safety & Allergen Information

The Makhana is a food business registered with the Food Safety and Standards Authority of India — FSSAI Lic. No. 23326005001818. Our products are sealed, ready-to-eat snacks and should be stored in a cool, dry place and consumed as directed on the pack.

Allergen note: our products may contain traces of nuts, and some flavours contain milk. Products are made in a facility that also handles milk. Please read the allergen information on each product page and on the pack label before consuming, especially if you have a food allergy or intolerance.

5. Orders & Payment

When you place an order, you make an offer to purchase the selected products subject to these Terms. We accept online payment only — UPI, debit and credit cards, net banking and supported wallets — processed securely through our payment gateway, Razorpay. We do not offer cash on delivery (COD).

  • Your order is accepted and a contract is formed only when your payment has been successfully completed and verified, we have recorded the order on our systems, and we have sent you an order confirmation. Until then, no order exists, and any amount charged for an order we do not accept will be refunded in full to your original payment method.
  • We reserve the right to decline or cancel any order at our discretion, including where stock is unavailable, the delivery address is not serviceable, a pricing or listing error has occurred, or we reasonably suspect fraudulent or abusive activity. In every such case, any amount already paid will be refunded to your original payment method.
  • We do not store your card, UPI or banking details; payments are handled entirely by Razorpay on its secure systems.
  • You are responsible for providing accurate delivery and contact details. We are not liable for delays or non-delivery caused by incorrect information.
  • You may request cancellation of an order before it has been dispatched by contacting us at themakhana.official@gmail.com. Once an order has been shipped, it cannot be cancelled, though our Returns & Refunds Policy may still apply.

6. Shipping

We ship across serviceable locations in India through third-party courier partners. Shipping is free on orders of Rs.599 or more; a flat fee of Rs.49 applies to smaller orders. Delivery timelines, charges and serviceable areas are set out in our Shipping Policy. Estimated delivery times are estimates only and are not guaranteed.

7. Returns & Refunds

As we sell food products, returns are limited: unopened, sealed packs may be returned or exchanged within 7 days of delivery, and damaged, wrong or spoiled items must be reported within 48 hours of delivery with unboxing photos. Approved refunds are made to your original payment method within 5-7 business days via Razorpay. 8. Intellectual Property

All content on the Site, including the brand name "The Makhana", logos, text, graphics, photographs, product descriptions and page design, is owned by or licensed to us and is protected under applicable intellectual property laws. You may not copy, reproduce, distribute or use any of this content for commercial purposes without our prior written permission.

9. Acceptable Use

You agree to use the Site only for lawful purposes. In particular, you agree not to:

  • use the Site in any way that breaches applicable laws or regulations;
  • attempt to gain unauthorised access to the Site, its servers or any connected systems;
  • introduce viruses, malware or other harmful code, or otherwise disrupt the functioning of the Site;
  • place fraudulent orders or misuse any offer, discount code or promotion.

10. Limitation of Liability

To the maximum extent permitted by law, The Makhana shall not be liable for any indirect, incidental or consequential loss arising out of your use of the Site or any products purchased from us. Our total liability in connection with any order shall not exceed the amount you paid for that order. Nothing in these Terms limits any liability that cannot be excluded under applicable Indian law, including your statutory rights as a consumer.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Delhi, India.

12. Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our practices, products or legal requirements. The latest version will always be available on this page, with the "Last updated" date shown above. Your continued use of the Site after any update constitutes your acceptance of the revised Terms.
